GENERAL TERMS AND CONDITIONS OF THE COMPANY WAFFEN FRIEDRICHS
- DENNY FRIEDRICHS WEAPONS RECYCLING & TRADE -

1. General  

 

    The following terms of delivery and payment apply exclusively to all deliveries and services as well as auctions, even if no separate reference is made to them in individual cases. By placing the order and accepting the goods, the buyer/orderer accepts these conditions as binding. Purchasing conditions of the buyer/customer are not recognized and are non-binding for the seller even if they are not expressly contradicted. Special agreements only apply if they are confirmed in writing by the seller. Deliveries of ammunition and firearms that require a permit are only made to the holder of a corresponding permit!

     

    ALL WEAPONS FROM THE USA ARE SUBJECT TO EXPORT CONTROLS 

    US GOVERNMENT (US STATE DEPARTMENT)  AND MAY NOT BE EXPORTED 

    THIS OBLIGATION ALSO PASSES AUTOMATICALLY TO THE PURCHASER OF THE GOODS.  

     

    2. Offers, conclusion of contract, prices

     

    Offers are subject to change and non-binding, even if this is not specifically mentioned. Technical or product-specific deviations are expressly reserved. If official or other approvals and approvals are required for the delivery, the order confirmation is subject to this reservation.

     

    The calculation is based on the prices valid on the day of delivery including the applicable VAT.

     

    Price changes, errors and prior sale.

    3. Delivery Dates  

    Delivery dates are approximate dates; they are adhered to as best as possible. In the event of force majeure, eg fire, strike, elementary events, etc., also at the sub-suppliers, the deadlines are delayed accordingly; in addition, the seller has the right to withdraw from the contract.

    we  always update our product availability. Due to prior sale, there may actually be deviations in product availability.

    The information about the items in stock  is not binding and will be checked after receipt of the order. If items are no longer in stock, we will inform you of this immediately by e-mail, stating the actual delivery time. In this case, you can declare the contract of sale null and void.

    Delivery times stated for items that are not in stock are based on approximate information from importers and wholesalers. This information is not binding. Items may be available earlier or later than stated. Especially due to the effects of the Corona Pandemic and due to the tense situation on the raw materials market, there are

     

    Claims for damages due to late delivery are generally only possible after a statutory period of grace has expired and only if intent or gross negligence can be proven. Partial deliveries are not made.

     

    In the case of existing payment arrears, also from other deliveries and services, the seller is entitled to suspend deliveries and services or to cancel orders. Delay in delivery is not justified by this.

     

    4. Passing of Shipping and Risk  

    Shipping including packaging takes place at the expense and risk of the customer. The dispatch takes place with suitable means of transport of our choice, unless the customer gives other instructions.

    We deliver all our items free of charge. An exception to this is the delivery of ammunition, for which we charge a flat rate of 35 euros.

    The risk is transferred to the customer when the delivery parts are handed over to the carrier. This also applies if the seller should have paid the shipping costs in a special case. If the shipment is delayed as a result of circumstances for which the customer is responsible, the risk passes to the customer from the day the goods are ready for shipment. We reserve the right to ship from a different storage location.

     

    5. Damaged Shipments

    Damaged shipments, even if there is no visible damage to the packaging, must be reported by the customer immediately (upon delivery) to the respective transport company, at the latest within the period specified by the transport company.

    The written statement of facts by the carrier must be made available to the seller immediately. In the case of postal delivery, the seller receives the confirmation directly from the post office. Please keep the packaging as proof. The damage recognized by the insurer will be credited to the customer's account after receipt. If no damage report is submitted, no settlement can be made.

    6. Return of Goods  

     

    Goods will only be taken back after prior written consent, with a deduction of 20% of the value of the goods. All goods must be in their original packaging and in unused or perfect condition. The goods are to be delivered free of charge to Südharz OT Benungen and to be adequately insured by the customer against transport damage and loss. Weapons, equivalent components and silencers must be returned using special shipping. Shipments sent without agreement, freight collect or cash on delivery by the customer will not be accepted.

     

    Custom-made products, firm orders, ammunition and auctions are non-returnable.

    7. Payment  

     

    All invoice amounts are payable immediately in advance. Payment must be made in advance by bank transfer to our account.

     

     

    8. Retention of Title  

     

    S upplied under extended retention of title. The seller remains the owner of the delivery of goods until all claims arising from the business relationship have been paid. When processing the goods provided by the buyer, the seller acquires co-ownership of the new items. The extent of co-ownership results from the ratio of the invoice value of the goods delivered by the seller to the invoice value of the remaining goods.

    It applies in terms of the BGB in its most recent version!

     

    The buyer is obliged to inform the seller immediately in writing, enclosing the relevant documents, in the event of access by third parties, e.g. through attachment, to the goods delivered under retention of title as well as in the event of composition, bankruptcy, general enforcement or insolvency proceedings.

     

    9. Warranty  

     

    Information about the quality, condition, performance, etc. of the goods are based on average values. Deviations from this are possible. In particular, this information does not represent guaranteed properties.

     

    In the case of auctions and exploitation, the apparent subjective perception applies to the best of our knowledge and belief.

     

    Complaints must be made in writing within 8 days of receipt of the goods, with reference to the invoice number and date. If the purchased goods show a defect in the guaranteed properties during the statutory warranty periods according to the HGB, the seller has the right to rectification, replacement delivery or withdrawal from the purchase contract. No guarantee of point of impact for firearms.

     

    As is customary in the industry, the warranty does not apply to wood and springs. Claims for damages against the seller only exist insofar as there is an intentional or grossly negligent breach of duty. Insofar as an obligation to pay damages also comes into consideration for slight negligence, the amount of the claim for damages is limited to five times the amount of the contractual consideration of the buyer. No liability is accepted for information on gun regulations and the suitability of guns for specific purposes. The information is provided outside of contractual obligations.

     

    10. Product Liability  

     

    If the buyer changes the goods or processes them further, the seller is released from all claims insofar as these are based on the change or processing of the goods. In these cases, the risk of liability is transferred to the buyer.

     

    11. Permissions  

     

    The delivery of firearms that require a permit, ammunition or equivalent items in the Weapons Act is only made to customers who have reached the age of 18 and are in possession of a valid purchase permit. This will be compared by us in consultation with the responsible weapons authority. This also includes the arms trade license of commercial customers.

     

    12. Privacy  

     

    It is pointed out that the customer's personal data received in connection with the business relationship is electronically recorded, stored and processed in accordance with the Federal Data Protection Act. The data is available to all companies associated with the seller. You have a right to free information about the data we have stored about you and, if necessary, a right to correction, blocking or deletion of this data.     13. Place of Performance and Jurisdiction  

     

    The place of performance and jurisdiction for any disputes arising from the business relationship between the seller and the buyer is Sangerhausen District Court. The relationships between the seller and the buyer are exclusively subject to the law of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods dated April 1, 1980 (CISG) does not apply.

    Should individual provisions of these general terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions. This also applies in the event of a contractual gap. The corresponding legal regulations then apply.
